The opinion responds to a 2023 request from the UN General Assembly under resolution 77\/276.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>&#8220;This marks only the fifth time in the Court\u2019s 78-year history that it has delivered a unanimous advisory opinion.&#8221;<\/em><\/p>\n<\/blockquote>\n\n\n\n<figure class=\"wp-block-image size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"750\" height=\"500\" src=\"https:\/\/sdgnews.com\/wp-content\/uploads\/2025\/07\/image-4.png\" alt=\"\" class=\"wp-image-7090\" srcset=\"https:\/\/sdgnews.com\/wp-content\/uploads\/2025\/07\/image-4.png 750w, https:\/\/sdgnews.com\/wp-content\/uploads\/2025\/07\/image-4-300x200.png 300w, https:\/\/sdgnews.com\/wp-content\/uploads\/2025\/07\/image-4-18x12.png 18w\" sizes=\"(max-width: 750px) 100vw, 750px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">The Questions Before the Court<\/h3>\n\n\n\n<p>The General Assembly asked the ICJ to answer two legal questions:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em><strong>(a)<\/strong> What are the obligations of States under international law to ensure the protection of the climate system and other parts of the environment from anthropogenic emissions of greenhouse gases for present and future generations?<br><strong>(b)<\/strong> What are the legal consequences under these obligations for States where they, by their acts and omissions, have caused significant harm to the climate system and environment \u2014 particularly with respect to vulnerable states and affected peoples?<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>The Court accepted jurisdiction and found no reason to decline the request, noting the \u201cunprecedented\u201d global relevance of climate change.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Legal Obligations: What States Must Do<\/h3>\n\n\n\n<p>The Court confirmed that states have binding legal obligations to address climate change under multiple bodies of law:<\/p>\n\n\n\n<p><strong>1. Climate Treaties<\/strong><br>States are bound by the UN Framework Convention on Climate Change (UNFCCC), the Kyoto Protocol, and the Paris Agreement. These include obligations to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mitigate greenhouse gas emissions<\/li>\n\n\n\n<li>Prepare and update nationally determined contributions (NDCs)<\/li>\n\n\n\n<li>Act in accordance with \u201ccommon but differentiated responsibilities\u201d<\/li>\n\n\n\n<li>Adapt to climate change and support others through finance and technology transfer<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>2. Customary International Law<\/strong><br>States must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Prevent significant harm to the climate system by acting with <strong>due diligence<\/strong><\/li>\n\n\n\n<li>Cooperate continuously and in good faith to prevent climate-related harm<\/li>\n\n\n\n<li>Regulate private actors whose emissions may cause harm<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>3. Other Environmental Treaties<\/strong><br>Obligations also derive from the:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>United Nations Convention on the Law of the Sea (UNCLOS)<\/li>\n\n\n\n<li>Vienna Convention and Montreal Protocol (and its Kigali Amendment)<\/li>\n\n\n\n<li>Convention on Biological Diversity<\/li>\n\n\n\n<li>Convention to Combat Desertification<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>4. Human Rights Law<\/strong><br>States must protect the climate system to ensure the effective enjoyment of human rights, including the rights to life, health, and a clean, healthy, and sustainable environment.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cDue diligence must be exercised not only through state actions but also through regulation of private actors contributing to emissions,\u201d the Court stated.<\/em><\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">What Happens When States Fail<\/h3>\n\n\n\n<p>The ICJ held that a breach of these obligations constitutes an <strong>internationally wrongful act<\/strong>, which may trigger:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Cessation<\/strong> of the wrongful conduct<\/li>\n\n\n\n<li><strong>Assurances of non-repetition<\/strong>, if warranted<\/li>\n\n\n\n<li><strong>Full reparation<\/strong>, including restitution, compensation, or satisfaction, provided a causal link is established<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>The Court explained that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cA sufficiently direct and certain causal nexus\u201d is the applicable legal standard, and attribution to specific states is possible even in complex, cumulative climate harm cases.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>While states&#8217; emissions may collectively contribute to climate change, the Court emphasized that each injured state can invoke responsibility against any state that breaches its climate obligations.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">No Special Treatment for Vulnerable States \u2014 But Rights Apply Equally<\/h3>\n\n\n\n<p>The Court found that legal consequences apply equally, regardless of whether a state is particularly vulnerable (e.g., a small island state) or specially affected.
