This year, \u201cDEI\u201d is nowhere to be found.<\/p>\n\n\n\n<p>In March, Starbucks got shareholder approval to replace \u201crepresentation\u201d goals with \u201ctalent\u201d performance for executive bonus incentives. At Molson Coors, \u201cPeople &amp; Planet\u201d metrics have displaced environmental, social and governance (ESG) goals, and the acronym DEI has disappeared altogether.<\/p>\n\n\n\n<p>Amid growing legal, social and political backlash, American businesses, industry groups and employment professionals are quietly scrubbing DEI from public view \u2014 though not necessarily abandoning its practice. As they rebrand programs and hot-button acronyms, they\u2019re reassessing decades-old anti-discrimination strategies and rewriting policies that once emphasized race and gender to prioritize inclusion for all.<\/p>\n\n\n\n<p>It\u2019s a stark contrast to 2020, when the murder of George Floyd unleashed a racial justice movement that prompted companies to double down on policies aiming to increase opportunity for groups that have historically faced discrimination. Less than a year after the Supreme Court struck down affirmative action in colleges and universities \u2014 a landmark ruling that found race-conscious admissions violated the right to equal treatment under the Constitution \u2014 a growing contingent of critics is arguing that DEI creates inequalities of its own. Some conservatives have blamed DEI for a variety of problems, such as the Baltimore bridge collapse and Boeing\u2019s safety woes, without providing evidence. Dozens of anti-DEI bills are being considered by state legislatures across the country, and DEI looks poised to become a wedge issue in this year\u2019s presidential election.<\/p>\n\n\n\n<p>Johnny C. Taylor Jr., chief executive of the Society for Human Resource Management, said that practitioners of DEI and its antecedents traditionally have focused on improving representation for historically marginalized groups, believing that \u201cthe magic bullet was diversity.\u201d<\/p>\n\n\n\n<p>\u201cWe underestimated that inclusion was the real challenge,\u201d Taylor said. \u201cNow people are saying, \u2018Not only should we probably call it something different, we should probably evolve it.\u2019\u201d<\/p>\n\n\n\n<p>This shifting landscape is forcing companies and consultants to adapt on the fly, with many acting preemptively to guard against the legal threats that have led some firms to recast or discard race-based initiatives. They\u2019re renaming diversity programs,&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/business\/2024\/02\/20\/corporate-diversity-job-cuts\/\" target=\"_blank\" rel=\"noreferrer noopener\">overhauling internal DEI teams<\/a>&nbsp;and working closely with lawyers. Some are moving away from using racial and gender considerations in hiring and promotion, and toward approaches that focus more on inclusion.<\/p>\n\n\n\n<p>To be sure, some companies have successfully fended off challenges. In April, a discrimination lawsuit against an Amazon grant program for Black, Latino and Native American contractors was dismissed by a federal court in Texas, though the plaintiffs have appealed. Pfizer and Starbucks have prevailed in court against similar legal attacks, though Pfizer modified the DEI program in question to make it race-neutral, according to court filings.<\/p>\n\n\n\n<p>And many companies have held onto their programs since the&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/politics\/2023\/06\/29\/affirmative-action-supreme-court-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court ruled against Harvard and the University of North Carolina<\/a>&nbsp;last June. Six months after the ruling, the employment law firm Littler Mendelson reported that 91 percent of the 320 executives surveyed said the ruling had not lessened their prioritization of DEI. In fact, 57 percent said they had expanded their DEI programming in the past year.<\/p>\n\n\n\n<p>But that sentiment is far more subdued than it was in 2020, when&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/business\/interactive\/2021\/george-floyd-corporate-america-racial-justice\/\" target=\"_blank\" rel=\"noreferrer noopener\">corporate America poured more than $50 billion<\/a>&nbsp;into racial justice causes. Meanwhile, the DEI industry \u2014 which was worth an estimated $9 billion in 2023, according to&nbsp;<a href=\"https:\/\/www.factmr.com\/report\/diversity-and-inclusion-market\" target=\"_blank\" rel=\"noreferrer noopener\">market researcher Fact.MR<\/a>&nbsp;\u2014 is also rethinking its public face, consultants say.<\/p>\n\n\n\n<p>Last fall, a few months after the Harvard-UNC decision, Taylor was already noticing growing antipathy toward the methods that companies, institutions of higher education and other organizations used to diversify in their ranks. So instead of referring to DEI, Taylor switched to calling these efforts \u201cIED,\u201d putting the focus on \u201cinclusion\u201d as DEI accrued cultural and political baggage. SHRM, the human resources association he heads, changed the name of its annual DEI conference to \u201cInclusion 2023.\u201d<\/p>\n\n\n\n<p>Some practitioners and executives dismissed the rebrand as superficial, Taylor said, a concession to political correctness. A&nbsp;<a href=\"https:\/\/news.bloomberglaw.com\/daily-labor-report\/firms-from-kkr-to-coors-flag-dei-as-a-risk-to-their-bottom-lines\" target=\"_blank\" rel=\"noreferrer noopener\">Bloomberg Law analysis<\/a>&nbsp;found that two dozen public companies have incorporated similar risk-factor language into their filings. And several companies, including Kohls, Salesforce and Workday, have dropped references to diversity goals in regulatory filings, the&nbsp;<a href=\"https:\/\/www.wsj.com\/business\/diversity-goals-are-disappearing-from-companies-annual-reports-459d1ef3\" target=\"_blank\" rel=\"noreferrer noopener\">Wall Street Journal reported<\/a>.<\/p>\n\n\n\n<p>Eric Ellis, CEO of Integrity Development, a DEI consultancy, said he\u2019s seen the \u201cbranding merry-go-round\u201d playing out for decades, tracing back to the wake of the civil rights movement. He expects the language to keep changing in response to public attacks, especially those by high-profile figures like Elon Musk, who in January&nbsp;<a href=\"https:\/\/twitter.com\/elonmusk\/status\/1742653436393406618?lang=en\" target=\"_blank\" rel=\"noreferrer noopener\">wrote on his social media platform X<\/a>&nbsp;that \u201cDEI is just another word for racism.\u201d<\/p>\n\n\n\n<p>\u201cIf every day you\u2019re getting pummeled and there is no effective strategy to protect the brand of DEI, there\u2019s no doubt it\u2019s going to be hard for it to survive,\u201d Ellis said. \u201cWe keep adjusting.\u201d<\/p>\n\n\n\n<p>Starbucks is \u201ca case in point\u201d for how companies are altering terminology around DEI, said Brian Bueno, ESG practice leader at Farient Advisors, an executive compensation consulting firm. After Floyd\u2019s murder by Minneapolis police, the company was among the first wave of firms incentivizing executives to achieve DEI targets, he noted.<\/p>\n\n\n\n<p>In its proxy statement last year, Starbucks said it was \u201cholding our senior leaders collectively accountable\u201d for goals that focused \u201con improvement in Black, Indigenous, and Latinx representation at the manager level.\u201d It also had goals around executive mentorship for BIPOC (Black, Indigenous, and other people of color) employees, scores on inclusive leadership surveys and other metrics, Bueno said.<\/p>\n\n\n\n<p>But starting this year, Starbucks is weighting its incentive plan more toward financial performance, tethering representation-related rewards to \u201ctalent\u201d goals. The company\u2019s&nbsp;<a href=\"https:\/\/s22.q4cdn.com\/869488222\/files\/doc_financials\/2024\/ar\/2024-proxy-statement.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">2024 proxy statement<\/a>&nbsp;references a goal to \u201censure that leaders have accountability\u201d for \u201ccreating a culture of belonging.\u201d<\/p>\n\n\n\n<p>\u201cStarbucks was an interesting case because they did come out with very specific goals,\u201d Bueno said. Now, \u201cthey\u2019re moving them from a more prominent area of the bonus plan to a little more backstage.\u201d<\/p>\n\n\n\n<p>Bueno estimated that 35 to 40 percent of large-cap companies&nbsp;<strong>\u2014<\/strong>&nbsp;those with a market capitalization of $10 billion or more&nbsp;<strong>\u2014<\/strong>&nbsp;have some DEI targets in their executive bonus criteria. About half of them frame these policies around quantitative targets, while the rest take a more qualitative approach. Still, \u201ccompanies are treading carefully,\u201d given the legal climate, he said.<\/p>\n\n\n\n<p>Starbucks has already withstood legal scrutiny of its policies: In September, a federal judge in Washington state threw out a lawsuit alleging Starbucks violated its duty to shareholders by endeavoring to diversify its workforce. The suit targeted the company\u2019s goals for hiring people of color and awarding contracts to \u201cdiverse\u201d suppliers and advertisers, as well as its tethering of executive pay to diversity goals.<\/p>\n\n\n\n<p>Betsy McManus, a spokeswoman for Starbucks, said the company has a goal of achieving \u201cracial and ethnic diversity of at least 30 percent at all corporate levels and at least 40 percent at all retail and manufacturing roles by 2025\u201d in the United States.<\/p>\n\n\n\n<p><em>\u201cReal inclusion requires intent, and diversity creates stronger communities and workforce,\u201d<\/em> McManus said in a statement emailed to The Washington Post. \u201cWith that in mind, we continue to make improvements and changes to ensure Starbucks remains a diverse, inclusive, equitable and accessible company.\u201d<\/p>\n\n\n\n<p>Eli Lilly scuttled DEI from its proxy statement this year and dropped mentions of \u201cracial justice\u201d \u2014 from eight times in 2023 to one in 2024. It also eliminated a section on progress toward meeting its racial justice commitments, which had been included in 2023.<\/p>\n\n\n\n<p>Yet the pharmaceutical giant still ties executive compensation to general goals of fostering diversity within the company \u2014 and it cites fostering a diverse workforce as a core priority. In a statement to The Post, the company said it removed the references to DEI \u201cto avoid redundancies in reporting.\u201d Information about the company\u2019s diversity efforts and racial justice commitments are detailed in its latest \u201cESG report\u201d as well as in a&nbsp;<a href=\"https:\/\/downloads.ctfassets.net\/srys4ukjcerm\/2ptsSfOsTZQBBm4VpxbLMw\/96f58e93b920a730b70483d0822bf0de\/Lilly_DEI_Impact_Report.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">separate DEI report<\/a>&nbsp;published last fall.<\/p>\n\n\n\n<p><em>\u201cLilly is committed to diversity, equity and inclusion \u2014 they are foundational in every part of our organization and essential elements of our success as a company,\u201d<\/em> Eli Lilly said.<\/p>\n\n\n\n<p>Molson Coors, meanwhile, erased DEI references from its \u201cPeople &amp; Planet\u201d metrics, a change from 2023. This year, it says, fostering an \u201cinclusive culture\u201d is central to its efforts. The company did not respond to a request for comment.<\/p>\n\n\n\n<p>Many large companies see a correlation between a diverse workforce and financial success, and routinely tout the \u201cbusiness case\u201d for DEI. Companies with the highest racial, ethnic and gender representation are 39 percent more likely to financially outperform, according to a&nbsp;<a href=\"https:\/\/www.mckinsey.com\/featured-insights\/diversity-and-inclusion\/diversity-matters-even-more-the-case-for-holistic-impact#\/\" target=\"_blank\" rel=\"noreferrer noopener\">2023 study by McKinsey &amp; Co.<\/a>&nbsp;involving more than 1,200 firms worldwide. In June of last year, a<a href=\"https:\/\/www.moodys.com\/web\/en\/us\/capabilities\/esg\/resources\/insights\/racial-diversity-on-north-american-corporate-boards-is-correlated-with-higher-ratings.html\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;study by the ratings agency Moody\u2019s<\/a>&nbsp;found that companies with higher ratings tended to have a greater racial diversity on their boards and in their executive ranks.<\/p>\n\n\n\n<p>In his&nbsp;<a href=\"https:\/\/reports.jpmorganchase.com\/investor-relations\/2023\/ar-ceo-letters.htm\" target=\"_blank\" rel=\"noreferrer noopener\">annual letter to shareholders<\/a>&nbsp;this year, JPMorgan Chase CEO Jamie Dimon emphasized that DEI <em>\u201cinitiatives make us a more inclusive company and lead to more innovation, smarter decisions and better financial results for us and for the economy overall.\u201d<\/em><\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/img-s-msn-com.akamaized.net\/tenant\/amp\/entityid\/BB1lQUGB.img?w=768&amp;h=512&amp;m=6&amp;x=1587&amp;y=740&amp;s=513&amp;d=513\" alt=\"JPMorgan Chase CEO Jamie Dimon, seen here at a December 2023 Senate hearing, has touted DEI initiatives in the past. (Jabin Botsford\/The Washington Post)<\/p>\n\n\n\n<p>Still, he said, JPMorgan will \u201cscour\u201d its programs to ensure they comply with the changing legal landscape. Similar assessments are playing out at Meta, Snap, DoorDash and Home Depot, which have culled their internal DEI teams in the past year. Others, such as Zoom, have outsourced their DEI work to consultants.<\/p>\n\n\n\n<p>Marilyn Fish, an Atlanta-based employment attorney who specializes in affirmative action, said she\u2019s seen companies \u201clooking at policies more holistically\u201d since the Harvard-UNC decision. Many of her clients \u2014 among them Fortune 500 companies \u2014 have renamed their programs to put \u201cinclusion\u201d up front, hoping it will resonate with employees.<\/p>\n\n\n\n<p>Some of her clients recently moved away from employee resource groups that had identified some people as \u201cmembers\u201d and others as \u201callies.\u201d Some opened up mentorship programs that were reserved for employees of certain races to people of all backgrounds.<\/p>\n\n\n\n<p><em>\u201cI do think that some programs were operating with an exclusivity that was potentially problematic,\u201d <\/em>Fish said. She doesn\u2019t think the new labels matter much from a legal perspective. <em>\u201cWhat matters most is how their programs are being implemented.\u201d<\/em><\/p>\n\n\n\n<p>Joelle Emerson, chief executive of DEI consultancy Paradigm, considers corporate DEI to be<em> \u201cone of the most visible civil rights initiatives of the past decade.\u201d<\/em> Much like affirmative action before it, DEI has faced resistance from within organizations and outside them \u2014 and now it\u2019s being thrust into the political limelight at a moment of acute polarization.<\/p>\n\n\n\n<p><em><strong>\u201c<\/strong>DEI has only been the acronym du jour since 2020,\u201d<\/em> Emerson said. <em>\u201cRegardless of what we call it, we\u2019ve done a really poor job storytelling what this work is actually about.\u201d<\/em><\/p>\n\n\n\n<p>The rebranding is clearly being sparked by the \u201cbaggage\u201d now associated with DEI, Emerson said. She pointed to conservative activist Christopher Rufo, who led the campaign to oust Harvard\u2019s first Black president, Claudine Gay, framing her exit as \u201cthe beginning of the end for DEI in America\u2019s institutions.\u201d<\/p>\n\n\n\n<p><em>\u201cCompanies with leaders that might be particularly supportive of DEI might also be the ones that are uniquely averse to drawing scrutiny,\u201d<\/em> Emerson said. <em>\u201cA lot of the companies that were vocal in the past have already been sued.\u201d<\/em><\/p>\n\n\n\n<p>Rhonda Moret, founder of Elevated Diversity, a DEI consultancy, said she\u2019s seen <em>\u201ca shift in what we\u2019re being asked to do.\u201d<\/em> Demand for programs such as unconscious bias training \u2014 high a few years ago \u2014 has dried up, she said. But there\u2019s been a spike of interest in employee resource groups, particularly those that aren\u2019t race-based, such as groups for caregivers, veterans and first-generation Americans.<\/p>\n\n\n\n<p>Like many consultants, Moret has been tweaking the terminology she uses to describe her work, now framing it as L&amp;I (leadership and inclusion). She prides herself on having always taken an \u201cinclusion-forward\u201d approach, and she\u2019s noticed the movement away from emphasizing \u201cdiversity\u201d in her field.<\/p>\n\n\n\n<p>But she\u2019s conflicted about whether to follow the tide and change Elevated Diversity\u2019s name.<\/p>\n\n\n\n<p><em>\u201cI am what someone thinks of when they think of diversity,\u201d<\/em> said Moret, who is Black. <em>\u201cDo I want to change who I am to be able to fit into another model?
