The proposal mandates large greenhouse gas (GHG) emitters to report annual emissions and related data beginning in 2027.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThis data is critical to inform the State\u2019s sustained efforts to protect our environment and improve the health and quality of life of all New Yorkers, and DEC is prepared to fill the data gaps left behind by proposed federal rollbacks,\u201d said Acting Commissioner Lefton.<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-who-must-report\"><strong>Who Must Report?<\/strong><\/h3>\n\n\n\n<p>Under the proposal, entities required to report include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Facilities emitting 10,000+ metric tons of CO\u2082e per year (e.g., power plants, landfills, natural gas compressors)<\/li>\n\n\n\n<li>Fuel suppliers providing GHG-generating fuels to end users in New York<\/li>\n\n\n\n<li>Waste transporters sending over 10,000 metric tons CO\u2082e out of state<\/li>\n\n\n\n<li>Electric power entities emitting or importing megawatt hours (MWh)<\/li>\n\n\n\n<li>Agricultural lime and fertilizer suppliers generating GHGs<\/li>\n\n\n\n<li>Operators of anaerobic digestion or liquid waste storage facilities above the emissions threshold<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-reporting-for-information-only\"><strong>Reporting for Information Only<\/strong><\/h3>\n\n\n\n<p>The program is strictly for <strong>data collection<\/strong> and does <strong>not impose emission reduction targets<\/strong> or require the purchase of allowances. According to DEC, the data will:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Strengthen the <strong>Statewide GHG Emissions Report<\/strong><\/li>\n\n\n\n<li>Guide future climate policies, including a <strong>cap-and-invest<\/strong> program<\/li>\n\n\n\n<li>Address federal regulatory rollbacks and serve as a <strong>backstop for vital GHG data<\/strong><\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe proposed Reporting Rule will enable us to collect the information necessary to develop effective strategies that reduce harmful air pollution and direct investments where they are most needed, while also protecting New York\u2019s consumers and economic competitiveness,\u201d Lefton added.<\/p>\n<\/blockquote>\n\n\n\n<p>Large emitters will also need to <strong>verify their data through DEC-accredited third parties<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-aligning-with-a-just-clean-energy-transition\"><strong>Aligning with a Just Clean Energy Transition<\/strong><\/h3>\n\n\n\n<p>The rule supports Governor Hochul\u2019s <strong>$1 billion Sustainable Future Program<\/strong>, unveiled in the 2025 State of the State Address.
